This privacy policy applies to data that we collect from users when they visit and use our online channels such as websites, apps, etc.
Furthermore, companies must fulfil certain information requirements when collecting personal data (directly from data subjects or from third parties). We also fulfil this information obligation in accordance with Articles 13 and 14 of the GDPR with this privacy policy.
We know that it is important for you to know what information about you is used and stored. When processing your personal data, we strictly observe the legal provisions and regulations applicable to us and are committed to strict data protection for all our users.

Our Privacy Policy is designed to help you understand how we collect, use and protect the information you provide to us. It explains how we handle your personal data and how you can access and update your preferences. The AVL Privacy Statement applies to all your interactions with AVL Software & Functions via the AVL Software & Functions website and its subsites (avl-functions.com) and to data from the following sources:
- We process personal data that we receive from our business customers, suppliers, other business partners and individuals in the context of business relationships with them or their employers.
- to the extent necessary for the provision of our services or for the organisation of our procurement of services, we also process personal data that we receive from publicly accessible sources (e.g. debt registers, commercial and association registers, press, Internet), which are legitimately transferred within the AVL group of companies, as well as data that we receive from authorities or third parties (e.g. event organisers, network partners, rating agencies, head hunters, etc.).
General information about the data we process
We collect “non-personal data” and “personal data”
Personal data is any information relating to an identified or identifiable natural person, including, for example, your e-mail, contact and company address data, etc., which you provide to us.
Non-personal data includes all information that cannot be used to identify you as an individual, e.g. usage data, generic demographic information, landing page hit rates relating to our website pages or URLs. If non-personal data is linked to personal data, it becomes personal data.

Information about the collection of personal data when visiting our website
The publicly accessible area of the above-mentioned websites can be used by visitors without having to disclose names, addresses or the like. AVL Software & Functions only requests such information if it is required for the provision of services or the fulfilment of requests (e.g. contact via email).
If you only use our website for informational purposes without providing us with any other information, we only collect the data that is technically necessary for us to display our website to you and to ensure stability and security (legal basis is Art. 6 para. 1 lit. f GDPR).
These data are:

- Date and time of access
- URL of the accessed page
- Status message about whether the request was successful
- Amount of data transferred
- the referrer URL from which the user came to the accessed page
- HTTP user agent (device, operating system, browser)
- Information that is stored in cookies set by us
- Log files that we have created to record an event that occurred during your visit (e.g. acceptance of the terms of use).
Information about the collection of personal data when you send us an e-mail
If you contact us by e-mail, via a contact form on our website (e.g. to download a publication) or via other areas on the website, the data you provide (e-mail address and, if applicable, your first and last name, as well as explicitly requested information or other data provided by you) will be processed by us to answer your questions, to process the transactions you have requested or to send you information about AVL Software & Functions products and solutions (legal basis is Art. 6 para. 1 lit b GDPR).
Further purpose of processing and legal basis

The purposes of data processing are primarily in line with the respective services provided or received. More detailed information on the purposes of data processing can be found in the relevant contractual documents and terms and conditions.
- In the context of the balancing of interests (Art. 6 para. 1 f GDPR)
Where necessary, we process personal data beyond the actual fulfilment of the contract to protect our legitimate interests or those of third parties.
- Assertion of legal claims and defence in legal disputes and official proceedings
- Marketing interaction, market and opinion research (e.g. making contact during events or at trade fairs, filling out questionnaires and other forms)
- Prevention and investigation of criminal offences
- Video surveillance and other measures to protect against burglary or to collect evidence in the event of security incidents
- Based on your consent (Art. 6 para. 1 a GDPR)
Where you have given us consent to process your personal data for specific purposes (e.g. analysing certain activities for marketing purposes, when registering to receive newsletters, when taking photos or videos at events, etc.), the processing is carried out and based within the scope of such consent, unless we have another legal basis where this is required. The consent given can be revoked at any time, but does not affect the lawfulness of the processing of data until revocation.

As a globally active company, we are subject to various legal obligations, i.e. statutory and official requirements or industry self-regulation. The purposes of processing may therefore include, for example, the assessment under tax law and fulfilment of control and reporting obligations.
- Due to a necessity for the protection of vital interests of the data subject or another natural person (Art. 6 para. 1 d GDPR)
If a visitor has been injured in our company and their personal data would have to be passed on to a doctor, hospital or other third party for this reason.
Privacy and trust go hand in hand. Both are important to us.

Your rights as a data subject
You have the right to information pursuant to Art. 15 GDPR, rectification pursuant to Art. 16 GDPR, erasure pursuant to Art. 17 GDPR, restriction of processing pursuant to Art. 18 GDPR and – where applicable – data portability pursuant to Art. 20 GDPR.
You also have the right to object to processing based on Art. 6 para. 1 lit. f GDPR in accordance with Art. 21 GDPR. We will then no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims. For your and our security, we reserve the right to request proof of your identity before we fulfil your request.
In addition, you have the right – if the requirements are met – to lodge a complaint with the supervisory authority for data protection, Art. 77 GDPR.
Use of automated individual case decisions
In principle, we do not use automated decision-making in accordance with Article 22 GDPR. If an automated decision is nevertheless made in exceptional cases, we will inform you separately in each individual case, insofar as this is required by law.
Storage of your personal data
In order to provide you with the best possible customer experience, we store the data you have provided during your interactions with AVL Software & Functions.
We delete the data arising in this context after storage is no longer required due to contractual and legal obligations. We may have to archive data beyond this period if this is required by statutory retention regulations. In such cases, we limit the processing to what is necessary to fulfil the statutory retention rules.
Deletion of your personal data

Security measures that we take when storing your data
Taking into account the state of the art, the costs of implementation, the nature, scope, context and purposes of processing as well as the risk, likelihood and severity of a potential infringement of the rights and freedoms of natural persons, AVL Software & Functions makes reasonable efforts to protect personal data against accidental and unlawful destruction and loss. AVL Software & Functions strives to ensure that personal data is used properly and to protect it from unauthorised access, use or disclosure. We use a combination of process, technology and physical security controls to protect personal data from unauthorised access, use or disclosure.
In addition, access to personal information is limited to AVL Software & Functions employees, contractors and agents who need to know that information to perform their assigned functions and to develop or improve our products and services.
Transfer of personal data to third parties
Transfer of your personal data to partners of AVL Software & Functions and/or AVL company
Any personal data that you provide online via AVL websites may be shared with other AVL group companies. We will only do this if it is appropriate. AVL group companies are bound by the group-wide privacy policy.
Occasionally, some or all of your personal data may be processed outside the EU or EEA in the following countries:
Brazil, China, India, Japan, South Korea, Russia, Thailand, Turkey and the United States.
Other countries may be added over time. Please refer to the current list of AVL partners at: https://www.avl.com/avl-worldwide. Transfers to AVL subsidiaries and / or AVL companies are made on the basis of adequacy decisions or other appropriate safeguards in accordance with Articles 44 et seq. of the GDPR, in particular standard data protection clauses of the European Commission.
Use of service providers
We use processors to perform various services. In this case, we ensure that the requirements pursuant to Art. 28 GDPR (provision describing the security precautions applicable when using processors) are complied with.
Secure transfer
Special categories of personal data are encrypted during transmission over the Internet using TLS encryption technology (TLS = Transport Layer Security) or similar technology.
Use of your personal data for marketing and advertising purposes
General remarks
In addition to processing your personal data for business reasons, we may use your data for the following marketing purposes (legal basis is Art. 6 (1) (f) GDPR):
- Sending of interest-based newsletters
- To invite you to events and webinars
- To keep you informed about the latest product and software releases, product recommendations, market trends/insights and promotions
- To invite you to participate in surveys that help us improve our communication and communication platform
- To send you emails with updates on technical developments and similar information
In some cases, we ask for your consent to use your data for marketing purposes and sales promotion measures (legal basis is then Art. 6 para. 1 lit a GDPR).

Cookies
Cookies are small files that are stored on your computer associated with the browser you are using. They are designed to contain a small amount of data specific to a particular client and website. They can be accessed either by the web server or by the client computer. This allows the server to deliver a page customised for a particular user, or the page itself may contain a script that recognises the data in the cookie and is therefore able to transfer information about the visit to the website to another.
Use of cookies
We use cookies to make it easier for you to use our website. Cookies are used, for example, to recognise you, your login and your preferences, or to offer you various customised functions, e.g. to show you content that is of interest to you. We use information from cookies to improve the navigation structure of the AVL Software & Functions website and to optimise its user-friendliness (legal basis is Art. 6 para. 1 lit f GDPR). A large part of the website can also be displayed without cookies.
Types of cookies
We use cookies on our website. Some of these cookies are necessary, while others help us to improve the user experience by giving us insights into how the website is used. Necessary cookies fulfil core functions. The website cannot function properly without them; the cookies can only be disabled by changing your browser settings. Analytical cookies help us to improve our website by collecting information about usage and reporting it back to us.
These cookies can be session or persistent cookies. Session cookies are deleted when you close your browser or shortly after you log out. Session cookies store a session ID. This can be used to assign various requests from your browser to the shared session so that your computer can be recognised when you visit our website again. Persistent cookies are automatically deleted after a period of time specified for the individual cookies.
Google Analytics
To constantly improve and optimize our AVL Software and Functions product and service offerings, we are using web tracking technologies. For this we are using Google Analytics, a Web analytics tool offered by Google Inc. (“Google”, https://www.google.com) that provides statistics and tracks web traffic.
Google Analytics requires the placing of “cookies” on the device from which you access the web pages. These cookies enable us to analyze the use of our web pages by you. In addition, for identifying trends and improving our online offer, usage data such as the page last visited, the browser used, date, time, etc. are being evaluated. The information generated by the cookie about the use of the web pages are usually transmitted to a Google server in the USA and stored there. Google has submitted to the EU-US Privacy Shield, https://www.privacyshield.gov/EU-US Framework.
AVL Software and Functions uses Google’s services by enabling the IP anonymization feature. This leads to Google storing the user’s IP address only in a shortened format, resulting in anonymization / masking. The anonymization or masking of the IP takes place after the IP addresses arrive in the Google Analytics data collection network, but before any storage or processing of the data takes place. On behalf of AVL Software and Functions, Google will use the information obtained from cookies to evaluate the use of the web pages by you, to compile reports on web page activity and to provide other services related to web page activity and internet usage to AVL Software and Functions. This is our legitimate interest in data processing. The legal basis for the use of Google Analytics is Article 6(1)(f) GDPR.
In addition, data submitted to Google via the Google Analytics service is linked by Google with third-party cookies associated with visits to other websites, such as when an advertiser uses their Google Analytics data to create more relevant ads or would like to more accurately analyze their traffic. You may prevent the cookie generated information (including your IP address) from being collected, transmitted to Google and processed by Google by downloading and installing the browser plug-in available at the following link (effective only for the device on which you install the browser plug-in): https://tools.google.com/dlpage/gaoptout (not for mobile devices).
Instead, you can prevent the placing of cookies on your device by adapting the settings in your browser software accordingly.
